Our longstanding client, MKM Entertainment LTD, asked for our assistance to diversify the offering at their flagship restaurant, Iron Bloom (www.ironbloomshoreditch.co.uk) based in Shoreditch, London.
From our work with MKM, and other licensed premises in the Shoreditch area, we were sensitive to the hostile reception that any application involving licensed activities receives from the authority.
The challenge was to overcome that hostility and demonstrate that adding the bar use to the existing restaurant would not result in harm. Having achieved the original change of use to restaurant on appeal, we were confident that this was possible.
As anticipated, the initial submission was met with hostility by the authority, who initially asked that the application be withdrawn as limited bar use is ancillary to a restaurant. This however did not fit with our clients’ objectives and ran the risk of opening them up to planning enforcement action, if the authority decided that the bar use was too intense.
We demonstrated the distinctions and requirements to the officer using examples of previous cases, and succeeded in convincing them that the use proposed was materially different to a restaurant with incidental drinking.
The authority then demanded submission of extensive management plans and modifications to address objections made by public consultees. Our analysis of the objections made it clear that they were based on the operation of other venues in the area, and the authority withdrew the request for modifications to the premises. The demand to submit additional management plans was however unreasonable, based on research we conducted into other similar sites in the borough.
There was no sign that the authority would concede our point or determine the application, we were instructed to appeal on the grounds that there had been no decision within the statutory period.
The inspector agreed that the bar use was materially different in scale and was acceptable as distinct use. We were able to demonstrate that the bar use would have no worse impact on the local area than the existing restaurant use, which was highly persuasive.
